With certain factors in place, a delayed C-section could lead to devastating results. If your child suffered injuries as a result of what you believe was doctor negligence, then you should consult with a birth injury lawyer in Cuyahoga County to discuss your case.

When medical professionals act or fail to act in a manner that is considered negligent, they may be found liable for resulting injuries. Contacting a lawyer is the best way to learn what your rights are.

Complications that May Require an Emergency Caesarian Section

There are complications that may require a doctor to perform an emergency C-section. A failure to do so or a delayed Caesarian could lead to serious or fatal injuries.

Here are some complications that may require a doctor to perform an emergency C-section:

baby isn't receiving enough oxygen;

baby's heart rate is too slow or too fast;

problems with the umbilical cord or placenta;

prolonged labor;

abnormal progression of labor;

baby is larger than thought; and

labor completely stops.

If a doctor fails to take action in a timely manner, and there is a delayed C-section, injuries to the baby and/or mother could indicate medical negligence. Talking to a birth injury lawyer in Cuyahoga County will help you learn if you have a legitimate case worth pursuing.

Determining Liability in a Delayed Caesarian

Despite a high number of Caesarians being performed in the U.S., there are still cases where babies and/or mothers are injured due to a delayed C-section. Injuries can range from brain damage to bodily injuries, such as to the arms or shoulders.

Even though a child was injured as a result of a delayed Caesarian, it doesn't always mean that the doctor is liable. You will need to establish that it was the doctor's negligence that caused the injuries. This can be very challenging to prove, so you should seek help from a birth injury lawyer in Cuyahoga County. A qualified lawyer will have an understanding of this unique area of the law, along with general medical knowledge.

Damages in a Birth Injury Claim

When your child's injuries are caused by medical negligence, you may be entitled to damages. Depending on the type of injury and the impact it may have on your child's life, you could face a lifetime of medical expenses. Damages may be available that not only address your current medical expenses, but also future ones. Medical expenses can include hospital stays, surgery, doctor visits, physical therapy, medication, rehabilitation, assistive devices and more.

Some injuries may require specialized care, such as a caregiver or special educational services. These are other damages that may be recoverable through a claim. A birth injury lawyer will consider carefully the financial impact a delayed C-section has and the resulting injuries could have on your child and family.

Hiring a Lawyer When Delayed Caesarian Occurs

Determining whether or not to proceed with a birth injury claim is not an easy decision. It is best to seek experienced legal counsel, in order to determine if you have a legitimate case that is worth pursuing.

You will want to hire a birth injury lawyer who you feel comfortable with and has experience in handling these types of claims. This important decision could impact the rest of your child's life.

Don't delay in seeking legal help. A lawyer can explain what the statute of limitations is for your state. He or she may also assist you with filling out the forms and paperwork that are necessary for proceeding with your claim. And an attorney may be able to help in assembling the evidence you will need to prove your case.

You should consult with a Cleveland birth injury lawyer if you believe that medical negligence resulted in your child suffering spina bifida. The long term costs of spina bifida could be recoverable through a claim.

An Overview of Spina Bifida

Spina bifida is a birth defect of the spinal column. It occurs when the spine does not completely fuse shut, leading to a lifelong disability.

There are 4 different types of spina bifida including:

Occult Spinal Dysraphism - improper growth of spinal cord;

Spina Bifida Occulta - not disabling and is a condition that doesn't display symptoms or signs;

Meningocele - part of the spinal cord comes through the spine, usually resulting in minor disabilities; and

Myelomeningocele - most severe type, with parts of spinal cord and nerves coming through the open area of the spine.

Myelomeningocele can also cause brain damage, due to a buildup of fluid in the brain.

Educational Challenges for Children with Spina Bifida

Depending on the severity of your child's challenges, they could be facing learning difficulties that may need to be addressed through special programs and services. Children with spina bifida could have problems with:

·         memory;

·         attention;

·         motor skills; and

·         other areas.

Some children may be integrated into regular classrooms and receive special education services. If the disabilities are severe however, it may be necessary to attend a special school that can meet their needs.

These long term costs of spina bifida may be compensated through a claim if your child's birth injury was the result of medical negligence. Speaking with a Cleveland birth injury lawyer is the best way to learn what legal options may be available.

Long Term Costs of Spina Bifida

In addition to the educational issues that parents may have to deal with, resulting in significant expenses, there are other long term costs of spina bifida that can burden a family.

Severe cases of spina bifida will require surgery. This can prevent further damage to the spine and reduce the chance of developing an infection. If there is fluid on the brain, then surgery may be necessary in order to drain it.

The cost of surgery and hospitalization can quickly add up, leaving parents to wonder how they will ever pay for the bills. A Cleveland birth injury lawyer can discuss with you if liability may be found with a doctor or other medical professional.

In addition, a child may have difficulty with getting around. Assistive devices such as:

·         braces;

·         crutches; and

·         a wheelchair can help.

These are additional expenses that may be addressed through a claim as well. Medication may also be a necessity, as some children with spina bifida deal with conditions like attention deficit hyperactivity disorder.

All of these long term costs of spina bifida should be discussed with a lawyer in order to learn if you may be entitled to compensation through a claim.

Help from a Cleveland Birth Injury Lawyer

You may need to seek help from a lawyer who has experience handling birth injury claims. The uncertainty of wondering if your child's medical condition was preventable may be worth the investigation. Your lawyer can evaluate your case to determine if it is worth pursuing.

If a lawyer finds you have a legitimate case, they may also be able to assist you with the complicated paperwork and forms that must be completed to move forward with your claim. They may also be able to help collect the medical evidence that will be necessary for your case.

Don't delay in seeking legal counsel as there may be a deadline in which you can file this type of claim. A lawyer will be able to explain to you the statute of limitations for your state.

Surgical procedures, such as gastric bypass, have benefited many people who want to lose weight. Along with the benefits, however, there is also the risk of suffering gastric bypass surgery complications. These could impact an individual's quality of life significantly.

If you believe medical negligence contributed to your injuries, you should speak with a Lorain County medical malpractice attorney about the possibility of filing a claim. A claim not only can hold the negligent party liable, but also can help you recover your financial, physical and emotional losses.

Common Gastric Bypass Surgery Complications

With any type of surgery, there are inherent risks involved. These risks may be elevated, however, with gastric bypass.

Some of the common complications that patients have experienced with gastric bypass surgery include:

incision infection;

irregular blood sugar levels;

abdominal hernia;

anemia;

staple line breakdown;

gallstones;

osteoporosis;

blood clots;

ulcers; and

leakage into abdominal cavity.

Another complication is known as "dumping syndrome" and is the result of the contents in the stomach moving too fast through the small intestine. This causes the contents to be dumped, with symptoms including fainting and nausea.

The stomach outlet, as it begins to return to a larger size, can also become stretched. Or the bypassed stomach can increase, leading to bloating. While these aren't life-threatening complications, they can be very uncomfortable.

Stomal stenosis is another gastric bypass surgery complication. If the connection between the intestines and stomach is too narrow, it can lead to nausea and vomiting after the patient eats. Malnutrition deficiencies are also common.

Some patients who suffer from gastric bypass surgery complications have to undergo additional surgery. This increases the risk of developing further problems. In the most severe cases, some patients die as a result of complications from their surgery.

Liability Stemming from Gastric Bypass Surgery Complications

You may wonder who can be held liable if you suffered complications after undergoing gastric bypass surgery. The surgeon could be found medically negligent if the procedure was done incorrectly, if there was a failure to properly monitor the patient, or if there was any other breach in his or her duty of care.

If a doctor failed to warn you of the risks adequately, and you might not have undergone the procedure knowing them, you could also hold the doctor liable if it results in injuries. To learn what your rights are, it is best to speak immediately with a Lorain County medical malpractice attorney.

Compensation that addresses the cost of your medical expenses including the surgery, hospital and doctor visits may be available. If you face additional surgery, these costs may be recoverable as well.

In addition, if you were out of work for a period of time, your lost income may be recoverable. Other damages may include pain and suffering, disability, mental anguish, and more. The best way to learn what legal options may be available after sustaining serious gastric bypass surgery complications is to consult with a Lorain County medical malpractice attorney at 1-877-863-6219.

When a doctor, nurse, surgeon or other medical professional makes a bad decision or acts in a manner in which the outcome isn't good, it doesn't necessarily mean you have a valid medical malpractice case. Elyria medical malpractice lawyers can help determine if you have enough cause to move forward with legal action.

Establishing a Medical Malpractice Case

In order to establish a medical malpractice case, you must first be able to demonstrate that a healthcare professional acted in a negligent manner. Poor results or complications don't always warrant a claim. In addition, decisions that are based on a doctor's best judgment and result in a negative outcome may not be cases of medical malpractice.

Negligence means that a medical professional failed to provide the expected standard of care. An argument that could be used in a medical malpractice case is if another healthcare professional, who dealt with a similar set of circumstances, would have made a different decision or pursued a different course of action.

Cases like this can be difficult to argue and prove. However, other types of negligence are more obvious. For instance, if a surgeon left a surgical instrument inside a patient, and it caused additional injuries, this might be an easier claim to prove. Likewise, if a pharmacist gave a patient the wrong medication and the patient suffered serious complications, you may have a valid claim.

Damages in a Medical Malpractice Case

In addition to establishing that medical negligence took place, you will need to prove that you suffered damages. If no injuries were suffered or the injuries were minor, they probably wouldn't warrant pursuing a claim. However, if the injuries were disabling, life-threatening or fatal, then you most likely will have a very valuable case.

Damages can address a number of things including your medical expenses, lost wages, future medical expenses and lost wages, earning potential if you became disabled, pain and suffering, mental anguish, reduced quality of life, wrongful death, and more.

Finally, you will need to prove that the negligence was the direct cause of your damages. This can be challenging when it comes to medical issues because previous injuries or conditions may play a role. For instance, if you developed complications from a surgery, an underlying medical condition may be to blame.

There are so many intricacies to this type of claim that seeking help from Elyria medical malpractice lawyers is the best way to determine if you have a legitimate claim worth pursuing. A number of things will need to be factored in before determining if you have the right to pursue a medical malpractice case.

This type of case can be very time-consuming and complicated. You will need to complete a significant amount of paperwork and forms. In addition, evidence will need to be collected. However, with the help of experienced legal counsel, you don't have to do it alone.

It is highly advised that you secure help from Elyria medical malpractice lawyers who have experience in medical malpractice cases. A lawyer should have a solid understanding of general medicine and any state or federal laws that may impact your case.

When there is a failure to diagnose a serious medical condition, such as an aneurysm, and it causes additional complications, compensation may be available. To determine if you have a case of medical negligence, you should speak with a medical malpractice lawyer in Ohio as soon as possible.

Overview of an Aneurysm

Aneurysms develop in a blood vessel and are considered to be life-threatening. There are 2 types of aneurysms that can develop. One is a dissecting type, which is the result of the inside layer of the blood vessel tearing, causing blood to flow through and separate the other layers.

Another type of aneurysm is a bulge, where a spot in the blood vessel balloons out. With this type, it can burst through the blood vessel if not detected and treated.

The 2 most common areas of the body to develop an aneurysm are the brain and the aorta, which is the largest artery in the body. If there is a failure to diagnose either type, it could lead to severe or fatal injuries.

Symptoms of an Aneurysm from Medical Malpractice in Ohio

Symptoms will depend on whether the aneurysm has developed in the brain or aorta. These are common symptoms, however, that trained medical professionals should be able to recognize.

If it is a brain aneurysm, the most common symptom is severe pain in the head. This pain is described as excruciating. Other symptoms include vomiting, nausea, vision difficulties, dilated pupils and sensitivity to light.

If it is an aortic aneurysm, symptoms include severe chest pain, trouble swallowing, back pain, sweating, shortness of breath and fast heartbeat. Before an aneurysm ruptures, there are additional symptoms that may be experienced. There may be problems with speech, perception, peripheral vision, memory and coordination.

Early detection and treatment of either type could mean the difference between life and death. It could also determine whether or not an individual suffers serious complications.

Complications of an Aneurysm Causing a Medical Malpractice Case in Ohio

If there is failure to diagnose an aneurysm, there are complications that can arise, including:

brain damage;

significant internal bleeding;

paralysis;

coma; and

death.

With an aneurysm being an especially dangerous condition to develop, immediate medical treatment is important. This usually involves surgical intervention. If there is a delay in diagnosing it, treatment options may not be available.

If an emergency room doctor or any other medical professional suspects the possibility of an aneurysm, tests should be done immediately. Not recognizing the symptoms or a delay in recognizing them may be considered forms of medical negligence.

If there was a delay in ordering tests or the patient wasn't put through any tests, this could also be a case of negligence. A failure to diagnose such a serious medical condition may lead to the doctor being held liable.

To learn what your rights are and if you have any legal options available, you should contact a medical malpractice lawyer in Ohio. A lawyer will take the time to evaluate the details of your case and determine if you should proceed with filing a claim.

If you were the victim of misdiagnosed breast cancer, or if there was a failure to treat your condition properly, you may have a case of medical malpractice in Ohio. To learn what your rights are, you should consult with a medical neglect lawyer in Ohio to discuss your case.

To prove medical negligence, you will need to establish that the medical professional owed a duty of care to you. In other words, he or she must have been involved in your treatment. You must also be able to show that the healthcare provider acted in a negligent manner, and it caused you to suffer serious or fatal injuries.

When Breast Cancer Is Misdiagnosed

Misdiagnosed breast cancer could lead to devastating results. Instead of treating the true source of your medical condition, you may receive treatment that is unnecessary or harmful.

Mistaking a medical condition for another is not uncommon. There are several reasons this can happen. One of the most common is that symptoms may mimic other conditions. This is why it's important that the treating physician thoroughly test and evaluate the patient in order to determine what the true diagnosis is.

A misdiagnosis could mean that lifesaving treatment, such as radiation or chemotherapy, is not provided. This can result in the cancer spreading or progressing.

It could also mean that the patient is given medical treatment for the wrong condition. This could be harmful to the body and cause additional complications.

Failure to treat breast cancer properly can occur when there is failure to diagnose any medical condition. Symptoms may be dismissed or tests may not be ordered. When a doctor doesn't take a patient's complaints or symptoms seriously, and it causes further injury, the doctor may be held liable.

Compensation Resulting from Medical Malpractice in Ohio

If it can be established that you were the victim of medical malpractice in Ohio, then you may be able to receive compensation. Not only could your medical bills be compensated, but so could your lost wages, or, if you no longer are able to work, your earning potential.

Additional types of compensation could be available that address pain and suffering, reduced quality of life, or wrongful death benefits if breast cancer was misdiagnosed and led to fatal results.

Medical malpractice often leads not only to financial losses, but also physical and emotional losses that can impact victims and their families. Medical neglect lawyers in Ohio will take all of this into consideration as they help prepare your case.

Establishing that medical negligence was the cause of your injuries will require appropriate evidence. A lawyer may be able to assist with the collection of this evidence, which could include your medical records, test results and any other documentation related to your injury.

You will also need evidence that establishes the losses you have suffered. This can come from a medical expert's testimony, how long you have been out of work, pain journal entries, and anything else that pertains to your condition and the resulting consequences.

IV errors are not uncommon in hospitals. Not all are serious, but many do lead to devastating consequences. If you were the victim of medical malpractice in Ohio, you may be entitled to compensation. An Elyria medical malpractice lawyer may be able to help.

Medical negligence can be found with treating physicians, nurses or other medical personnel involved in your care. You will need to seek legal counsel in order to determine who potentially may be held liable for your injuries.

Common Types of IV Errors

The majority of IV errors happen during the preparation or administration of medication. However, they can also occur as a result of negligence or defective equipment.

Some of the more common types of IV errors include:

·         incorrect solution or medication used;

·         improperly injecting medication;

·         incompatible combination of drugs;

·         administering medication at wrong time;

· defective valves and/or pumps; and

· administering incorrect dosage of medicine.

Another serious type of IV error is when fluid leaks into the tissue surrounding the area where an IV has been injected. This is known as an extravasation injury.

If this type of injury isn't diagnosed, or if there is a misdiagnosis, it could become life-threatening, even fatal. These types of negligence could lead to the filing of a claim for medical malpractice in Ohio.

Common Causes of IV Errors

Sometimes IV errors occur when medical personnel work quickly. If a patient is in a dire medical situation, in a rush to insert an IV or administer medication through it, a mistake could be made.

Another cause of IV errors is a failure to follow proper procedures or steps that ensure the safety of a patient. Taking shortcuts can lead to a serious mistake.

Staff shortage is another common cause. Medical personnel who may not be qualified to insert an IV and administer medication may be used when there isn't enough help. This is a serious form of medical negligence.

Faulty equipment can be yet another cause for IV errors. In a case like this, it may lead to the manufacturer being held liable for any resulting injuries.

Filing a Medical Malpractice Claim

By consulting with an Elyria medical malpractice lawyer, you may learn if you have the right to file a claim for medical malpractice in Ohio. Whether you were injured in a large hospital such as The Cleveland Clinic, or a medical center such as EMH Elyria Medical Center, compensation may be available.

Compensation in a medical malpractice claim can address your medical bills, lost wages, pain and suffering, and more. Damages may be recoverable for not only your financial losses, but also your physical and emotional suffering. A lawyer can evaluate your case to determine if you should proceed with filing a claim.

In addition, an Elyria medical malpractice lawyer may be able to assist you with the complex paperwork and forms that will need to be completed. Or they may be able to help assemble the evidence that will be necessary in your case. To arrange for a no-cost consultation, home or hospital visit, contact us today - 1-877-863-6219 or 1-440-372-0810.

While we entrust our health and well-being to the medical professionals, there is also the risk that a mistake could be made. When it results in severe consequences, then compensation for your injuries may be available.

Nurses have a lot of responsibilities and sometimes take care of a number of patients. Their fast-paced environment could lead to a nurse's mistake.

One of the more common types of nursing errors that can happen is a mistake with medication. This can be a result of giving medication to the wrong patient or giving the wrong kind of medicine.

A nurse may also give a patient the wrong dosage, either too little or too much. Too little could prevent the patient from being properly treated or alleviating pain, while too much could lead to additional medical complications.

Administering the medication improperly or not recognizing a severe adverse reaction could also be a result of a nurse's mistake. Proper care and attention to details can help avoid these types of medication errors.

Failure to monitor a patient properly is another common nursing error. The more patients a nurse is responsible for, the more difficult monitoring can be. Or let's say a nurse is dealing with a critical patient at University Hospitals, other patients might be neglected.

Communication errors also can happen verbally when exchanging information with a doctor, another nurse, or any other medical professional. It can also be done by recording incorrect information on a patient's medical records or failing to write down something important.

Nurses are sometimes responsible for assisting doctors and surgeons as well. Mistakes during a medical procedure, surgery or labor and delivery could lead to a nurse being found liable.

Errors can happen when a nurse feels rushed, pressured, stressed or fatigued. A shortage in staff or too many patients can also result in medical mistakes. All of these factors can be considered in your Ohio medical malpractice claim by involving a Lorain County med mal lawyer in your case.

Compensation in an Ohio Medical Malpractice Claim

If it can be demonstrated that you or a loved one was the victim of a medical malpractice mistake and it caused serious or life-threatening injuries, then compensation may be available. Some of the types of compensation that you could be entitled to include your current and future medical expenses, lost wages and/or earning potential, mental anguish, reduced quality of life, disability, and more. A Lorain County med mal lawyer can work with you to determine all of the losses you have suffered.

Contacting a Lorain County med mal lawyer is the best way to learn if you have a valid claim that is worth pursuing. A lawyer may also be able to help collect the evidence that demonstrates liability and the impact your injuries have had on your life.

Consulting with a Cleveland birth injury firm is the best way to learn if you have a valid claim that is worth pursuing.

An Overview of Placental Abruption

While placental abruption is not a common complication of pregnancy, it is certainly a serious one. The placenta is vital to the developing baby's growth. Placental abruption occurs when the placenta partially or completely peels away from the uterus' inner wall.

This can lead to not only injuries to the fetus, but also to the mother. It is a complication of pregnancy that requires immediate medical care. If there is a failure to recognize that placental abruption has taken place, it could be life-threatening to both the baby and mother.

Symptoms of Placental Abruption

Some of the symptoms that may indicate placental abruption has taken place include:

sudden abdominal pain;

severe back pain;

vaginal bleeding (amount varies, although sometimes there is no bleeding);

constant uterine contractions; and

uterine tenderness.

This serious complication can occur from 20 weeks of pregnancy and onward. Not all of the symptoms are experienced when this complication arises, so if there is any suspicion that it has occurred, doctors must exercise immediate medical care.

Sometimes an ultrasound can detect placental abruption, but in some cases, it may not be detected until after the delivery has taken place. In this case the placenta usually has a blood clot attached to it.

Risk Factors for Placental Abruption

The cause of placental abruption is not always known. It can occur as a result of an injury to the mother's abdomen, such as in a fall or a car accident. It can also happen when there is a loss of amniotic fluid that surrounds the baby or the amniotic membranes rupture.

There are some risk factors, however, that could increase the chance of placental abruption. The treating doctor should be aware of these risk factors. For instance, it is most common in women who are 35 years and older. The risk is also increased with each pregnancy and if the mother is carrying multiples (twins, triplets, etc.).

Health conditions in the mother, such as a blood-clotting disorder or high blood pressure, could also be risk factors.

Placental abruption can deprive the baby of nutrients and oxygen, lead to neurological problems later on, cause premature birth or result in death. It can also cause the mother to go into shock or lose a lot of blood. If the blood loss is severe, it may even necessitate a hysterectomy.

If you suspect that your doctor was negligent in some manner and you have suffered placental abruption, you could be entitled to compensation through a birth injury claim in Ohio. You should immediately speak with a Cleveland birth injury firm to determine if you have a case of medical negligence and should proceed with filing a claim.

A 7-year-old boy is now blind after contracting meningitis. The boy's family, however, claims it's because of the pediatrician's misdiagnosis. They have since filed suit against the physician for medical malpractice.

The boy first fell ill in October 2009. According to the family, he was experiencing severe headaches. He visited the pediatrician several times and was told he had an ear infection. Later he was told he suffered from migraines.

In November 2009, the boy's condition worsened and his doctor indicated he was in "acute distress." However, according to the family, the doctor did nothing further to help.

On the night of November 3, 2009, the boy was found unresponsive. He was airlifted to the hospital, later lapsed into a coma and diagnosed with meningitis. (Meningitis is a bacterial infection that causes the membranes that cover the brain and spinal cord to become inflamed.) Three weeks later, the boy recovered but was blind.

The family claims that the boy's doctor continued to "blow off" the claims, failed to diagnose the condition which allowed the meningitis to worsen. They say that if the doctor would've ordered a spinal tap, the condition would've been detected, the boy would've received antibiotics and would not be blind today.

They have filed a medical malpractice lawsuit against the doctor alleging that the treatment provided fell below the reasonable and acceptable standard of medical care as required by law.

As a result of the condition, the boy has also allegedly suffered respiratory failure, impaired speech, seizures and brain damage.

An Overview of HIV

Human Immunodeficiency Virus (HIV) is a condition in which the immune system is attacked, allowing the potential for life-threatening illnesses, cancer and ultimately AIDS. A compromised immune system can make it difficult for an individual to fight off typical bacteria and viruses that healthy people can combat.

Symptoms of HIV don't always show up immediately. In fact, it can take up to 10 years before they manifest. During this time the immune system continues to weaken, increasing the risk of developing AIDS. Those with HIV can transmit the disease to others.

Pregnant mothers with HIV can pass it onto their children. If doctors are aware that the mother has the condition, they will need to take precautionary steps to protect the fetus. A failure to do so could result in deadly consequences.

Mother-to-Child HIV Transmission

Mothers can pass HIV onto their children while still in the womb or during delivery. This is known as perinatal transmission. However, they also can transmit it through breast milk.

While some children will not acquire HIV despite the mother being infected, the risk is significant enough that doctors must take measures to reduce the chance of transmission.

The most important step is to recognize that the mother has HIV. A failure to detect symptoms could be a case of medical negligence.

Some of the symptoms that may indicate a mother has HIV include:

tuberculosis;

ulcers over a patch of skin;

non-Hodgkins lymphoma; and

ulcers in the mouth or genital area.

Mothers who have HIV need to be properly treated so that it is not transmitted to their children. Not only should breastfeeding be discouraged, but also medication administered during the late stages of pregnancy and delivery can reduce the risk of transmission.

HIV can affect not only a child's quality of life, but also the duration of it. While some can live with HIV until an old age, others will develop AIDS and other serious complications, leading to premature death.

If your baby contracted HIV due to a doctor's preventable mistake, then it could lead to the filing of a medical malpractice claim. To understand your rights and the legal options you have available, it would be in your best interest to consult with a Lorain County birth injury lawyer.

Lawyers can help you assemble the evidence that will help build a solid case. They can also call on medical experts to provide testimony that demonstrates a doctor's negligence was the cause of your child's injuries.

When you have been the victim of doctor or hospital negligence, you could be entitled to medical malpractice compensation in Ohio. You will need the experience of an Elyria medical malpractice lawyer who can help determine the types of compensation you could be eligible to receive.

Overview of a Medical Malpractice Claim

In order to qualify for compensation related to a case of medical malpractice, you will need to first establish that a doctor, hospital or any other medical professional acted in a careless or reckless manner. This is not always easy to prove, which is why you will need the assistance of a lawyer.

Medical malpractice cases can arise from surgical errors, misdiagnosing a patient or giving the wrong medication. These are just some examples of negligence that may lead to filing a claim.

In addition to proving that there was medical negligence, you will need to show that it was the direct cause of your injuries. In other words, a pre-existing condition would not be a direct cause.

Finally, you will need to show the severity of your injuries and how they impact your life. Your injuries must be serious enough that it would warrant the pursuit of a claim.

Medical Malpractice Compensation

If you can establish that medical negligence caused your serious injuries, then you will be able to pursue medical malpractice compensation in Ohio. The amount of compensation you could be entitled to will depend on your injuries and how they have or will impact your life.

Some types of compensation have a specific monetary value attached to them. For instance, the following medical bills could be recovered through a claim:

·         hospital stays;

·         surgical procedures;

·         medication; and

·         physical therapy.

Lost wages are another type of compensation that has a monetary value attached. The time you have missed from work and any future time that may be missed because of medical treatment that will be needed later on could also be recovered.

You may even be compensated for services that you are no longer able to perform, such as taking care of your home, children, cooking or cleaning. If you must pay someone to do these things for you, then compensation could be available.

In addition to being awarded for those things that have a monetary value attached to them, you could also be entitled to what are known as indirect damages. This is compensation that addresses those losses that don't have a set monetary value such as pain and suffering, loss of enjoyment of life, disability, or loss of companionship.

Although not commonly rewarded, in extreme cases of gross negligence, punitive damages may also be awarded. These are a way to punish the medical professional for their willful or malicious actions and to help prevent future problems. However, proving gross negligence is not an easy task.

You should speak with an Elyria medical malpractice lawyer as soon as possible to learn what your rights are and if you are entitled to pursue medical malpractice compensation in Ohio after being the victim of medical negligence.
Caring for a child with cerebral palsy can be very expensive. These costs will remain with the family for the rest of that child's life. You may have legal options available to address those expenses if your child suffered a cerebral palsy birth injury in Ohio caused by medical negligence. Contacting a Cleveland cerebral palsy lawyer should be your next step.

How Special Needs Trust Helps Cerebral Palsy Birth Injury in Ohio

A special needs trust can help parents who have children with cerebral palsy. This allows the beneficiary to receive the benefits of the trust without losing the ability to obtain benefits and services through the government.

Without this trust, a person who is disabled cannot inherit more than $2,000 without it interrupting government benefits. However, the expenses to care for a child with cerebral palsy will definitely exceed this amount, so a special needs trust can help significantly.

You will need to consult with a lawyer who handles birth injury and special needs cases. A cerebral palsy birth injury lawyer in Ohio will have the experience and knowledge that you need.

The special needs trust allows for family contributions to be made, as long as they do not duplicate the benefit programs the government provides. It can help gain access to inheritances or personal injury settlements.

You may have a claim for personal injury if your child suffers a cerebral palsy birth injury in Ohio due to medical malpractice. If a doctor's actions or lack of actions caused your child to suffer a preventable injury, such as brain damage, then he or she may be held liable. A Cleveland cerebral palsy lawyer can address this.

Some of the ways that a special needs trust can help is by allowing you the ability to purchase or obtain the following:

·         goods and services that increase your child's quality of life and bring more pleasure to it;

·         out-of-pocket dental and medical expenses;

·         entertainment, trips or vacations;

·         eyeglasses;

·         electronic equipment;

·         transportation;

·         vehicle maintenance;

·         materials for recreational activities or hobbies;

·         insurance (including premium payments);

·         necessary dietary needs;

·         caregiver/personal attendant salary; and

·         rehabilitation.

These are just some of the ways that a special needs trust can help. To learn more about this and how to set it up, you should seek legal counsel immediately.

You should also seek help from a lawyer if you want to know what you can do when you believe your child was diagnosed with a condition that was caused by a doctor's negligence. You could be entitled to compensation through a claim that addresses your child's cerebral palsy birth injury in Ohio.

Compensation could include medical expenses (both current and future), loss of earning potential, pain and suffering, permanent disability, and other physical and/or emotional losses that have been suffered.

Contact a Cleveland cerebral palsy lawyer who can help you collect the medical evidence that proves negligence of the doctor and demonstrates the severity of your child's injuries and the impact it will have on the rest of his or her life.

Forms of Cerebral Palsy

Cerebral palsy is a condition in which brain damage causes impaired movements. Although there are 9 forms of this condition, the 3 that are most common include diplegia, quadriplegia and hemiplegia. These are known for spastic movements or stiff muscles.

Athetoid, dystonic and choreoathetoid are classified as dyskinetic forms. Movements are involuntary and slow. Another type of cerebral palsy is ataxic, which affects depth perception and balance.

While the majority of individuals who have cerebral palsy are classified with one form, there is the possibility to have more than one form, which is known as mixed cerebral palsy.

Overview of Mixed Cerebral Palsy

The most common mixture of forms is a spastic type with athetoid. The results are stiffness of muscles, combined with involuntary, writhing movements. The stiff muscles are usually the first symptoms noticed. It isn't until a child reaches anywhere between 9 months and 3 years old that the involuntary movements are recognized.

While this is the most common mixed cerebral palsy, there are other combinations. If your child was diagnosed with mixed cerebral palsy and there is evidence of medical negligence, a Cleveland birth injury firm can help.

Complications of Mixed Cerebral Palsy

Treatment of mixed cerebral palsy is much more difficult, with many medical complications that can arise. One of the more common complications is seizures, which can vary from mild to severe.

There are also neurological complications that can make swallowing or talking difficult. This can lead to nutritional problems, facial grimaces and drooling. Not only can the child experience difficulty with speaking, but he or she may not be able to understand others.

Mental retardation is yet another complication that could occur with mixed cerebral palsy. Like seizures, it can range from mild to severe. However, evaluating a child's mental capacity can be difficult when communication problems exist.

Other complications include hearing and vision problems. Some children may experience blindness or strabismus (cross eyes), which could require surgical correction.

Caring for a child with mixed cerebral palsy is a huge challenge. And when it was the result of doctor or hospital negligence, then you may have legal recourse. This is important because the cost to care for and treat a child with cerebral palsy can be extremely high.

A cerebral birth injury attorney in Ohio can evaluate the details of your case to determine if you have a claim for medical negligence. If so, you could be entitled to compensation that covers your child's medical expenses, including future care and special accommodations that need to be made to your home.

You could also be eligible to receive compensation for disability, pain and suffering, reduced quality of life and other losses that your family has suffered. For legal help, contact a Cleveland birth injury firm at 1-877-863-6219.

You should seek help from a birth injury lawyer in Cleveland, Ohio, if your child suffered serious injuries such as brain damage as a result of jaundice. You could be entitled to compensation that covers more than just your medical expenses.

An Overview of Jaundice

Jaundice is a common condition in newborns. The child will have a yellowish skin color, and sometimes the whites of the eyes will be yellow. Therefore, it is a fairly easy condition to recognize. But when it's not and no treatment is provided, then it can quickly escalate into a dangerous condition.

When jaundice is not treated, it can turn to kernicterus. This condition can cause irreversible brain damage. However, it can also lead to other serious injuries such as behavioral difficulties, vision and hearing loss, seizures, and cerebral palsy.

Some of the signs of kernicterus include:

severe head contortions;

extreme fatigue (child may be difficult to waken);

fever;

decreased muscle tone (hypotonic);

increased muscle tone (hypertonic);

high-pitched cry; and

head tilting.

Severe cases of jaundice are generally treated with phototherapy - newborns are placed under a special light. In some cases a blood transfusion may be necessary, and in other cases a special fiber-optic blanket is placed on the baby.

The important thing is that some form of treatment be done. When a child's bilirubin levels escalate, they can quickly get out of control and cause severe brain damage.

Jaundice is not difficult to detect or treat. Therefore, when doctors fail to do either, and it results in your child suffering what are preventable injuries, then they can be held liable.

Damages Available in an Ohio Birth Injury Claim

An Ohio birth injury claim can address the damages you have suffered as a result of your child being the victim of medical negligence. Brain damage can lead to permanent disability, which you may be compensated for. However, you could also be entitled to your child's medical expenses. This includes any future medical expenses that your family may face.

Other types of compensation can address not only your financial suffering, but also your emotional injuries, including pain and suffering, mental anguish, reduced quality of life, and in cases when the injuries are fatal, wrongful death benefits.

A Cleveland birth injury lawyer will take the time to sit down with you and discuss your case. He or she will be able to determine if the doctor or hospital could be held liable for your child's injuries. A lawyer will also provide an estimate on how much compensation your family could be entitled to.

Additionally, lawyers will assist you with the many forms and paperwork that have to be filled out, making sure they are done on time. They can help collect evidence that will prove not only liability, but also the impact your child's injuries will have.

Pursuing this type of claim can be very lengthy and complicated, which is why seeking legal representation is the next thing you should do.
